Enforcement

Enforcement continues to be one of the regulators key tools and priorities. The consequences of enforcement action can be significant in terms of financial penalties, restrictions on business, reputational damage, and the cost of remedial action. For individuals, disciplinary action could result in them losing their jobs and being restricted or prohibited in their future career. The Regulator's investigatory powers are wide-ranging and detailed. The consequences of non-compliance are significant and include the ability to bring charges of contempt of court and possible criminal prosecution.

It is essential that every regulated firm is aware of the powers of Enforcement. The enforcement process is a difficult course to navigate and it is important for any firm faced with the prospect of an investigation to consider the possible implications and consequences.

Stephen Glynn Stephen Glynn
Director, Head of Enforcement
Dubai Financial Services Authority (DFSA)

Stephen Glynn is the Director and Head of Enforcement with the Dubai Financial Services Authority, the independent regulator of the Dubai International Financial Centre (DIFC). He has extensive experience in the regulation of financial and capital markets, financial services and products and listed and unlisted corporate entities.

Stephen's portfolio of responsibilities include enforcing obligations that apply to regulated entities in the DIFC, members of the Dubai International Financial Exchange and Dubai Mercantile Exchange, and Reporting Entities that list their products and make offers of securities in the DIFC.

Stephen was formerly employed in various senior positions with the Australian Securities and Investments Commission having responsibility for various divisions including, Markets and Investments, Managed Investments, Financial Services Regulation, Corporate Investigations and Financial Analysis.

He is a forensic financial analyst and a former member of the Investigations Committee of the National Council of Certified Practicing Accountants (CPA) Australia. He has extensive experience supervising deposit taking institutions, superannuation funds, general and life insurance providers, broking houses, financial advisers, managed fund providers and financial planners.

Before joining the DFSA Stephen was the Managing Director of Financial Services Compliance, a consultancy providing compliance and risk management services to the Australian financial services industry.

Stephen has both Bachelors and Master degrees from Australian Universities.

Mr Orchard has a distinguished background as a Barrister/Solicitor for over 18 years. He has received a Bachelor of Laws (with Honours), a Graduate Diploma in Legal Practices and a Master of Laws, all from the Queensland University of Technology. Additionally, Mr Orchard has received a Graduate Certificate in Business Administration from the University of Queensland and a Certificate in Arabic and Arab Studies from the University of Durham (UK). Mr Orchard has focused over the last 15 years on financial services regulation where he has held roles as Director of Enforcement of the Australian Securities and Investments Commission and Managing Director, Enforcement of the Dubai Financial Services Authority.

Wayne Jones Wayne Jones

Wayne Jones is a partner based in Clyde & Co's Abu Dhabi office, specialising in commercial litigation and re/insurance. Wayne spent four years at Clyde & Co in the UK before joining the Dubai office in 2001, and has been practicing in the Middle East since. He relocated to Abu Dhabi in 2004 to help set up Clyde & Co's office in the capital. He is qualified in England and South Africa.

Wayne advises on a broad range of commercial disputes in the UAE and other jurisdictions. He is a recognised specialist in the GCC region for insurance and reinsurance work, and has extensive knowledge of the London and European markets. He has a broad regional practice combining contentious claims work and commercial litigation with an increasing amount of GCC regulatory work. Wayne is a frequent speaker at regional insurance market events and a regular contributor to industry publications.
